Terms and Conditions
1. General Provisions
1.1. In these general terms and conditions and on the website www.cxejewellery.com, “the seller” refers to Elisa Wang, with registered office at Schonekeerstraat 135, 8930 Menen, Belgium, and company number BE1026.319.683.
1.2. For questions or information, the seller can be reached at hello@cxejewellery.com.
1.3. These general terms and conditions determine the mutual rights and obligations of the seller and the buyer when concluding a contract via the webshop.
1.4. The contract is concluded exclusively in Dutch or English.
1.5. The contract is not digitally archived by the seller and is no longer accessible after completion of the order process. After placing the order, however, the buyer will receive a confirmation email with the details of the order.
2. Offer and Order
2.1. The offer contains a clear description of the products offered and is valid while stocks last.
2.2. These terms and conditions are made available before the order is placed. By ticking the checkbox “I agree with the terms and conditions,” the buyer declares agreement.
2.3. An order is placed by selecting an item (and, if applicable, the correct size), adding it to the shopping cart, and then entering customer and payment details. By clicking “pay,” the buyer commits to payment of the order.
2.4. The seller reserves the right to refuse orders in case of suspected misuse, bad faith, commercial purposes, or stock depletion.
3. Delivery
3.1. The seller aims for fast delivery. The stated delivery times are indicative. The maximum delivery period is 30 days, unless otherwise agreed or in cases of force majeure (see Article 8).
3.2. The risk of loss or damage passes to the buyer from the moment of delivery.
3.3. The buyer is responsible for correctly entering the delivery address. Errors are at the buyer’s risk.
3.4. Delivery is currently only possible within Belgium and the Netherlands.
3.5. Any damage or incomplete delivery must be reported by email within 8 calendar days. After this period, the delivery is considered complete and compliant.
4. Prices, Shipping Costs and Retention of Title
4.1. All prices include VAT but exclude shipping costs.
4.2. Shipping costs are clearly indicated during the ordering process.
4.3. The sold items remain the property of the seller until full payment has been received.
5. Payment
5.1. The seller offers secure payment options via [e.g. Bancontact, iDEAL, credit card, …].
5.2. Payment is made via secure connections. The order will only be processed after receipt of payment.
6. Right of Withdrawal
6.1. The buyer has the right to withdraw from the purchase within 14 calendar days without giving any reason. This period starts the day after receipt of the goods.
6.2. To exercise this right, the buyer must submit an unambiguous statement by email or include it with the return shipment.
6.3. The buyer will receive a refund of all payments (incl. standard delivery costs) within 14 days of receipt of the withdrawal notice, provided the goods have already been returned or proof of return shipment has been provided.
6.4. The refund will be made using the same payment method unless otherwise agreed. No additional fees will be charged.
6.5. The buyer must return the goods no later than 14 days after withdrawal.
6.6. Return costs are borne by the buyer.
6.7. Items that have been used or from which the tags have been removed will not be accepted. Items may only be tried on as in a physical store.
6.8. Sale items can also be returned.
7. Warranty
7.1. The seller guarantees that the products conform to the order.
7.2. Nothing in these conditions affects the statutory warranty of conformity as established in the law of 1 September 2004 on consumer protection in the sale of consumer goods.
8. Force Majeure
8.1. The seller is not liable for delays or non-performance due to force majeure such as strikes, natural disasters, transport problems, supplier failures, or pandemics.
9. Customer Service
9.1. The seller attaches great importance to customer satisfaction.
9.2. Complaints must be reported by email within 8 calendar days of delivery, stating name, order number, and the relevant item.
9.3. The seller undertakes to handle every complaint as quickly as possible. This does not imply any acknowledgment of liability.
10. Applicable Law and Jurisdiction
10.1. This contract is governed exclusively by Belgian law.
10.2. In case of disputes, only the courts of the district where the seller’s registered office is located have jurisdiction.
